INGLESIDE ESTATE, AVALON PALM SPRINGS and the legendary MELVYNS w/ Robert Barnes. Area General Manager for Ingleside Estate and Avalon Palm Springs.
– DISCUSSION of Avalon Palm Springs; a hotel that’s close to downtown, w/ 72 rooms, a lot of bungalows, all in a beautiful setting.
– DISCUSSION of Ingleside Estate (built in 1922) is similar, but smaller, ADULTS only, 30 rooms.
– DISCUSSION that Melvyn’s is in the Ingleside Inn. Celebrating 50 years this year. All the awards Melvyn’s has won.
– REPORT that there is a partnership w/ the Food and Wine Festival that will run from Oct.,13 – Nov.,14. “Dining Through the Decades” and each week will feature the menu items from a certain decade of Melvyn’s history. Starting w/ 1975 on.

1. Sat., Nov., 15 the official 50th anniversary party on the Ingleside Lawn. Band, open bar, $75. Come in 50’s or “rat pack” attire.

– REPORT that Ingleside is open 24/7. Melvyn’s is open 5 – 9 PM Sunday thru Thursday and the dining room is open from 5 – 10 PM Friday and Saturday, but the bar will stay open until 12 midnight on Friday and Saturday.

1. How often do I need to clear the trash on my computer. (Really no need. Only if you need space. Just keep 10% free on your hard drive. Even once every couple of years.)
2. AT ‘T says it won’t do video back up anymore? (Just like dial up service is no longer needed.)
– REPORT that you should read the emails you will see that it’s a scam BECAUSE IT DOES NOT MAKE SENSE.
– Report that if you open the email you may enable the sender to access your information, etc.
3. How often should you have a phone checked? (Wait until something ISN’T WORKING)
– REPORT that WALKING IN to the store is great and they’ll take a good look @ things for you.
– DISCUSSION that you can bring things in, if you can, or he will work w/ you over the phone and he will also come to you.
– REMINDER not to let anyone IN TO YOUR COMPUTER if you don’t know them.
– RECOMMENDATIONS that they will do a diagnostic exam of your computer FIRST. On a case-by-case basis.

1. What does “charged as an adult” mean? (Under 18 and you’re in the juvenile system. Less rights than as an adult. Conducted in Judges’ chambers. Objective is to re-habilitate. The Prosecutor decides if you can be charged as an adult. Some differences occur @ 16 and 17. Under 16, you CANNOT be tried as an adult)
2. What’s the Supremacy Claus? (Pre-emption doctrine. Article 6, Clause #2 of the Constitution. Establishes that the Constitution, federal laws made in accordance w/ it, and treaties are the supreme Law of the Land. When a state law conflicts with federal law or a treaty, federal law or treaty takes precedence.)
– FOCUS OF ROBERT’S PRACTICE.
1. Personal bankruptcy. There are lots of chapters in personal bankruptcies. Either Chapter 7 where you get all your debts discharged as long as you get rid of all the secured items. Mortgages also. You CANNOT discharge student loans, judgements against you from a DUI, or a tort, or your last 3 years of income taxes. Or Chapter #13 where if you make more than the median income in CA ($70,000/yr for a single person) you MUST do a 13. Chapter 13 has a payment plan.
2. BK will be on your FICA for 10 years.
– REPORT that when you file a Chapter 7 Robert can get you a 700-credit score in a year if you do what he says.

3. How do some defendants afford such expensive defense lawyers? (The Constitution provides for adequate defense of any defendant and when the State wants to be certain of a conviction and no successful appeal, the state underwrites the best defense lawyer possible. Prosecutors don’t bring cases UNLESS they have an air-tight case.)
– DISCUSSION of some of the problems AI has caused in legal issues. CREATED CASES, ETC.
4. Is driving under the influence of marijuana getting worse? (Yes, depends on the strength. Has gotten so much stronger. Drivers may be more impaired by marijuana than alcohol. In Texas you use to be able to drive w/ an open container.)

1. What can you tell us about the Affordable Care Act? (Also called Covered CA., He hopes the subsidy will be renewed. Not his real area of expertise.)
2. What part will AI play in healthcare? (AI is just a tool.)
– REPORT that Medicaid is particular to individual states. He wants his team to be up to date with all plans.
– REPORT that the annual election period is Oct., 15 to Dec., 7. Challenge is there are plans that are terminating. You’ll get notices in the mail if yours is being canceled. Plans are being changed left and right. REVIEW YOUR PLANS.
– DISCUSSION of the changes to MEDICARE PART D – the most utilized component of your Medicare because you take your medications EVERY DAY.
– REPORT on Medicare Part D. For drugs. Most Medicare Advantage Plans have this. Medicare is going to put a cap in 2025 on the out-of-pocket maximum of $2000. for Part D. GREAT.
– DISCUSSION of the insurance problems in California, due to the actions of the Insurance Commissioner.
Possible limit of $2,000. for out-of-pocket costs. Affects the formulary going forward. 33% of personal costs will go up to 50% next year.
– REPORT on Medicare Part D. For drugs. Most Medicare Advantage Plans have this. Medicare is going to put a cap in 2025 on the out-of-pocket maximum of $2000. for Part D. GREAT.
REPORT on Change to Medicare Part D, which is your prescription drugs. You can get this one of 2 ways;
a. GOOD NEWS; Putting an “out of pocket” maximum on Part D. $2,000. Max. This will automatically change, established by CMS (Centers for Medicare and Medicaid Services).
b. Part of Medicare Advantage.
– REPORT that all costs WILL INCREASE for most other folks. Watch the changes in drug costs, deductibles and co-payments.
– REPORT that Brian will serve his clients in their home, in his office, on the phone. REMEMBER HE WILL COME TO YOUR HOME. He has all the special classification to do all of this. The rules are different in other states.
