1. Is the legal information presented on television and the Internet credible, safe and will it hold up in court? (It’s always a good idea to have more sources to educate and inform folks. Perhaps to go over everything w/ an attorney. Small Claims Court is also a good source. You don’t always need an attorney in EVERY situation and some of the forms can be filled out easily on-line. There are quite a few ways to save money. There’s a lawyer’s referral service (760) 568-5555)
– REPORT that when you choose an attorney; 1. Interview more than one. 2. Ask about fees. 3. Ask who will actually be DOING the work. 4. Ask if they are board-certified.
– DISCUSSION that in CA. there are many specialties in which a lawyer can be certified.
– DISCUSSION that Walter’s specialty is in civil trials. Walter has been tested in many areas to be accorded with that certification. A lawyer has to be licensed in each state in which he wants to practice.
– DISCUSSION of Small Claims Court. $12,500 is the limit and there are limits to the number of times you can use the Small Claims Court.

1. Personal bankruptcy. There are lots of chapters in personal bankruptcies. Either Chapter 7 where you get all your debts discharged as long as you get rid of all the secured items. Mortgages also. You CANNOT discharge student loans, judgements against you from a DUI, or a tort, or last 3 years of income taxes. Or a Chapter 13 where if you make more than the median income in CA ($70,000/yr for a single person) you MUST do a 13. A Chapter 13 has a payment plan.
2. BK will be on your FICA for 10 years.
