6. What is the real story on student loans? (Many folks worked very hard to pay off their student loans. When they reformed the bankruptcy law in 2005, student loans were made non-dischargeable. Difference in the amount of the loans when it came to the school. There was a lot of abuse of the system at this point in time. Then a judge let a person discharge their student loan if certain conditions were met. Dept., of Ed. And Dept., of Justice has now said you can discharge your student loans thru a bankruptcy w/ a couple of extra filings if you meet the criteria.)
– DISCUSSION of Robert’s charges for bk for a student loan; Basic fee for BK, the $100. or so to do the initial; $250. to prepare; $1500. for more paperwork. $1700. for filing and $450. Total is less than the student loans.
7. What is “stolen valor”? (Actually, is a REAL crime. Federal statute from 2013. Illegal to lie about military service as it is an insult to folks who served.)
– FOCUS OF ROBERT’S PRACTICE.
1. Personal bankruptcy. There are lots of chapters in personal bankruptcies. Either Chapter 7 where you get all your debts discharged as long as you get rid of all the secured items. Mortgages also. You CANNOT discharge student loans, judgements against you from a DUI, or a tort, or last 3 years of income taxes. Or a chapter 13 where if you make more than the median income in CA ($70,000/yr for a single person) you MUST do a 13. A Chapter 13 has a payment plan.
2. BK will be on your FICA for 10 years.
REPORT that when you file a Chapter 7 Robert can get you a 700 credit score in a year if you do what he says.
